No Illegal or Harmful Use
You may not use the Services to publish content or engage in activity that is harmful to others or illegal under applicable law. Prohibited activities include:
Disclosing private, sensitive personal information about others
Distributing malware or other malicious code
Unlawful distribution of controlled substances and drug contraband
Unlawful distribution of prescription medications, including promotion, marketing, or sale without a valid prescription
Gambling
Hosting child pornography or content harmful to minors (any site found hosting or linking to such content will be suspended immediately and reported to law enforcement)
Hosting FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi schemes, MLM/Pyramid schemes, High-Yield Interest Programs (HYIP), or related sites
Hosting or linking to websites intended to deceive the public, including sites listed at aa419.org and escrow-fraud.com
Hosting or linking to anonymous proxy servers
Infringing on intellectual property rights, including unauthorized copying or distribution of movies, music, books, photographs, software, or other copyrighted work
Money laundering
Phishing or identity theft
Selling weapons or ammunition
No Unauthorized System Access or Network Abuse
You may not use the Services to gain access to any network or system without permission. Prohibited activities include:
Accessing another network without permission, probing for vulnerabilities, or breaching security measures
Attacking other networks, including Denial of Service (DoS) attacks
Intercepting or monitoring data without permission
Running a file-sharing site
Running software that interfaces with an IRC (Internet Relay Chat) network
Using any automated tools (deep-link, page-scrape, robot, crawl, index, spider, offline reader, click spam, macro programs, internet agent, or similar) to access, copy, index, acquire information, generate impressions or clicks, input/store/search information, or monitor servers without authorization
System Performance
Consuming excessive server resources is prohibited
Scripts or processes that negatively impact system performance or disrupt services for other customers are not allowed
No Adult Content
Distributing pornography or adult-related content is prohibited
Offering escort services is prohibited
No Storage of Backups
Backing up personal data to a hosting account is prohibited
Services are designed for website hosting, not as a data repository
Backups may be removed from your hosting account at any time
Unlimited Bandwidth
Divine Concepts provides unlimited bandwidth for web traffic, allowing your website to handle any volume of visitors without restriction.
Responsible Usage
Clients must follow responsible usage policies to maintain fair resource allocation and prevent abuse of hosting infrastructure.
Security Measures
Hosting packages include proactive security measures, such as regular updates and patches, to protect your website from threats and vulnerabilities.
Data Protection
Clients are responsible for regularly backing up their data to prevent loss or corruption.
Divine Concepts strives to ensure data security but cannot guarantee against all potential issues.
Acceptable Use Policy (AUP)
Activities such as storing malicious content, monopolizing server resources, or circumventing intended use of the product are strictly prohibited.
Policies ensure a secure and equitable hosting environment.
Prohibited Activities
Running TOR services
Using weak or poor passwords
Conducting cryptocurrency-related activities within the hosting environment
Enforcement
Violation of the Acceptable Use Policy may result in suspension or termination of hosting services.
Divine Concepts enforces strict measures to maintain network integrity and policy compliance.
How much disk space and bandwidth will my plan include?
Disk space and bandwidth is “Unmetered” which means you are not charged according to the amount of disk space or bandwidth you use. However, that being said, we do require all customers to be fully compliant with our Terms of Service and its policies, which includes our Acceptable Use Policy (“TOS”), and to only utilize disk space and bandwidth in the normal operation of a personal or small business website.
For example, such customers who are using 25% or more of system resources for longer than 90 seconds would be in violation of our TOS, which includes our Acceptable Use Policy and other policies. Please see our TOS or contact us with any questions.
What happens if I exceed usage?
If we have concerns about your account’s bandwidth or disk space utilization, you will receive an email asking you to reduce usage. Again, it is very rare for a customer who is managing a personal or small business website to exceed our TOS, which includes our Acceptable Use Policy and other policies.
Definition of Spam
Divine Concepts defines unsolicited bulk email as spam, except when:
There is a prior relationship between the sender and recipient, and the message concerns that relationship
The recipient has explicitly consented to receiving the email
Client Responsibility
Clients should only send or receive bulk mail that they have requested, consented to, or reasonably expect due to an existing relationship
Unacceptable Practices
Divine Concepts takes swift action against users engaged in:
Sending unsolicited bulk mail for marketing or other purposes to recipients who have not consented
Using Divine Concepts’ infrastructure for unsolicited bulk mail
Operating mailing lists without express permission of all recipients or maintaining illegally obtained “cleaning lists”
Failing to promptly remove invalid, undeliverable, or unwilling recipients from mailing lists
Collecting responses from unsolicited email sent from accounts on other Internet hosts in violation of this AUP
Advertising Divine Concepts’ facilities in unsolicited bulk mail
Including Divine Concepts’ name or IP addresses in unsolicited email headers
Failing to secure a client’s mail server against public relay, which may result in spam delivery
Divine Concepts reserves the right to examine clients’ mail servers to ensure compliance
Response to Complaints or Incidents
Upon receiving a complaint or becoming aware of an incident, Divine Concepts may take appropriate actions at its discretion.
Actions for Clients
Issue a warning
Suspend the client’s account
Revoke or cancel the client’s service access privileges entirely
Actions for Third-Party Abuse
Notify the third party’s network administrator of the incident
Request that the incident be addressed according to this AUP and/or the ISPA Code of Conduct (if applicable)
In severe cases, suspend access to the third party’s entire network until abuse is prevented
Costs and Liability
Charge offending parties for administrative costs and any machine or human time lost due to the incident
Investigation Assistance
Assist other networks or website administrators in investigating credible suspicions of prohibited activity
Legal and Enforcement Actions
Initiate civil or criminal proceedings as deemed necessary
Share information about the incident with other Internet access providers
Provide relevant user details to law enforcement agencies
Service Suspension or Termination
Suspend or terminate service as provided in the agreement
This policy applies to all prohibited usage, including viruses, worms, malicious code, or other unknown causes
